Terms of Service

1. Acceptance of Terms

By accessing or using DreamPulze AI (including the Machi AI Intelligence Core and any associated products or features), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service.

These Terms constitute a legally binding agreement between you and DreamPulze AI ("we", "us", "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

DreamPulze AI is an AI-powered career operating system that helps users get hired faster and excel in their careers. The Service includes, without limitation:

• Machi AI Work Buddy — AI meeting prep, post-meeting debriefs, and workplace coaching.
• AI Interview Coach — real-time interview simulation and feedback.
• Resume Coach — AI-driven resume building and optimization.
• LinkedIn Profile Coach — profile improvement and positioning guidance.
• Apply Coach — personalized job application strategy and tracking.
• Career & Business Advisory — strategic career planning and business coaching.
• Career Intelligence Hub — market insights, skill gap analysis, and learning paths.
• Portfolio Builder — professional portfolio creation tools.

We may add, modify, or remove features at any time. We will provide reasonable notice of material changes where practicable.

3. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. Users under 18 must have parental or guardian consent.

4. Accounts & Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at support@dreampulzeai.com if you suspect unauthorized access or a security breach.
• You may not share your account, sell, or transfer access to any third party.
• We reserve the right to suspend or terminate accounts that appear to be compromised or in violation of these Terms.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to generate content that is false, misleading, defamatory, harassing, or harmful to others.
• Attempt to circumvent, reverse-engineer, or tamper with any AI models, security features, or access controls.
• Scrape, harvest, or systematically collect data from the Service without prior written consent.
• Use automated tools, bots, or scripts to access the Service in a manner that imposes an unreasonable load on our infrastructure.
• Upload or transmit viruses, malware, or any code designed to disrupt or damage the Service.
• Impersonate another person, organization, or DreamPulze AI itself.
• Use the Service in any manner that violates applicable laws or regulations, including employment, privacy, and data protection laws.

We reserve the right to investigate and take appropriate action, including account termination, for any suspected violation of this section.

6. AI-Generated Content

The Service uses artificial intelligence to generate resumes, cover letters, interview feedback, career plans, coaching advice, meeting notes, and other content ("AI Output"). You acknowledge that:

• AI Output is generated based on your inputs and is not a guarantee of employment, promotion, or any specific career outcome.
• AI Output may occasionally be inaccurate, incomplete, or not suitable for your specific situation. You are responsible for reviewing and verifying any AI Output before acting on it.
• AI Output does not constitute professional legal, financial, medical, or HR advice.
• You own the AI Output generated from your inputs, subject to our underlying IP rights in the models and platform.

You grant us a limited, non-exclusive license to process your inputs through AI models for the purpose of delivering the Service to you.

7. Intellectual Property

All platform technology, branding, product names, UI designs, AI models, and underlying software are the exclusive property of DreamPulze AI or our licensors, protected by copyright, trademark, and other intellectual property laws.

You retain ownership of original content you submit to the Service (e.g., your resume, work history, uploaded documents). By submitting content, you grant us a worldwide, royalty-free license to use, store, and process that content solely to provide and improve the Service.

You must not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Subscriptions & Payments

• Certain features require a paid subscription. All pricing is displayed in USD unless otherwise stated.
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• All payments are processed securely by Stripe. We do not store your full card details.
• We may change subscription pricing with at least 14 days' notice to your registered email address. Continued use after the effective date constitutes acceptance of the new price.
• Taxes may apply depending on your jurisdiction and will be displayed at checkout.

9. Credits & Tokens

Some features consume AI credits or tokens from your plan allocation. Credits:

• Do not roll over between billing periods unless stated otherwise in your plan details.
• Have no cash value and cannot be transferred, exchanged, or refunded.
• May be adjusted as we update AI model costs or feature availability, with reasonable notice.

10. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

We offer a 7-day refund on first-time purchases if you are unsatisfied with the Service. Refund requests must be submitted to support@dreampulzeai.com within 7 days of the initial charge. Subsequent renewals are non-refundable except where required by applicable law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI Output is not guaranteed to be accurate, current, or appropriate for any specific purpose. Career outcomes depend on many factors beyond our control, and we make no representation that use of the Service will result in employment or advancement.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DREAMPULZE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless DreamPulze AI and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service.
• Your breach of these Terms.
• Content you submit to the Service that infringes a third party's rights.
• Your violation of any applicable law or regulation.

14. Third-Party Services

The Service integrates with or links to third-party platforms including Google (Calendar, OAuth), Stripe, and AI model providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party services.

Connecting a third-party integration (e.g., Google Calendar) is optional. You can revoke access at any time from within the relevant product settings or via the third party's authorization dashboard.

15. Termination

You may terminate your account at any time by contacting us at support@dreampulzeai.com. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, pose a security risk, or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including IP rights, disclaimers, limitation of liability, and indemnification) will continue to apply.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Delaware, and you consent to personal jurisdiction in those courts.

If you are located in the European Union or another jurisdiction with mandatory consumer protection laws, you may also have additional rights under those local laws.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice at least 7 days before the changes take effect. The "Last updated" date at the top of this page reflects the most recent revision.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account before the effective date.
